The tractate is built unlike the others: it gathers the sages' testimonies about what they heard from their teachers, mixed together regardless of subject. Tradition links it to the day Rabban Gamliel was deposed and everyone previously kept out entered the study house—and the received tradition was gone over anew.

Here is asked the question by which the Mishnah explains itself: why record an individual's opinion if the law does not follow it? So that a later court, answers the tractate, may rely on it if it sees fit. There is no Gemara at all; it is read as a key to how transmission itself works.

Order: Nezikin. There is no Gemara in either Talmud—the tractate remained mishnah.
